Consumer is any person concluding a contract of law for purposes mostly not pertaining to their commercial or independent professional activities.

Cancellation Right

As a consumer you are entitled to cancel this contract with 30 days without giving reason or cause.

The cancellation period is 30 days from the day you or a representative designated as such by you, other than the shipping company, has taken in possession the goods.

In order to exercise your right of cancellation you have to notify us, Active Wearables Gmbh, Schlachthausgasse 14/9, 1030 Vienna, Austria, shop@pocket-sky.com) by means of an unequivocal declaration (sent by post or an e-mail) of your decision to cancel the contract.

You can use the attached sample cancellation form or go to your customer account to generate a return form, none of which are mandatory.

In order to keep the cancellation period, it is enough for you to send the notification of the cancellation before the end of the cancellation period.

Consequences of Cancellation

If you cancel this contract, we are obliged to refund all payments that we have received from you, including shipping costs (but excluding the additional costs caused by your choice of another than the cheapest standard shipping provider proposed by us) without delay, at the latest within 30 days from the day we received your notification of cancellation.

For the refund we will make use of the same means of payment you have used for the initial transaction, unless something different was explicitly agreed with you. In no case will you be charged any fees for the refund.

We can withhold the refund until we have received the goods or until you have given proof of having sent back the goods, depending of whichever is earlier.

You have to send back the goods without delay, but within 30 days upon the notification of cancellation to us (Active Wearables GmbH, Schlachthausgasse 14/9, 1030 Vienna, Austria).

You keep this deadline by sending the goods before the end of 14 days.

The costs of returning the goods will have to be borne by you.

You will only have to bear any costs related to a depreciation of the goods if the depreciation is due to your handling the goods for examining their property, quality and functionality beyond an adequate measure.
